Abstract

 

  This dissertation entitled "Justice for disciplinary action in the vision of Theravada Buddhist Philosophy" has three objectives : 1) to study about debates in discipline system of civil government officers, 2) to study about the vision of Buddhist philosophy relating with justice and punishment, 3) to study about the vision of Buddhist philosophy relating with justice in disciplinary action. This research is qualitative research.

            This research found that there were three debates relating to disciplinary action to civil government officials. First, it was focus on rules having intention to guarantee justice. When bringing rules to practice, there is finding of unfairness hidden in the rule using method constantly. There is complicated process, difficult to understand, issuing of other rules which is intrusive into the power of superior, double standards and duplicated punishment in one single conduct. Second, there is no focus on rules, but opening of opportunity to use discretion power to interpret in disciplinary action. Finally, it depends on subjective decision of the authorities having different concept. This case, it is considered that discipline is only a tool to claim the righteousness to the authorities only. Third, there is focus of person who takes part in using rules and the authorities do not understand about real objectives of punishment. Officer who does the practice does not have enough clarity in the role and duty. The person who is punished does not strictly follow the discipline. These are unfair to perform disciplinary action to civil government officers.
